Terms and Conditions for Courses, Individual Events, and Day Trips (Terms and Conditions for Travel see below)

1.1 Registration and Fees

The announcement of events is non-binding. Registration is an offer to contract. The registrant must provide all information necessary for processing the contract. The
event contract is concluded by the VBW’s declaration of acceptance (registration confirmation). The registration confirmation serves as proof of participation and must be brought to the events. Oral or telephone registrations are, in deviation from § 1 paragraph 4, binding if they are accepted in writing by the VHS. Upon conclusion of the event contract, contractual rights and obligations are established between the VBW as the organizer and the registrant(s). The VBW may make participation dependent on personal and/or material prerequisites. The event fee is based on the current announcement of the VBW at the time of receipt of the registration. The registration obligates (regardless of actual participation) to pay the stated fee and any special costs. The participant fee and special costs are due in full on the day the event begins.

1.2 Fee Reductions

Fee reductions are available for our courses (with the exception of senior gymnastics):

50% reduction upon presentation of a valid family card from the state capital Wiesbaden.

20% for pupils, students, military/civil service personnel and trainees, volunteer card holders and severely disabled persons. The reductions are granted upon presentation of a correspondingly valid proof.

20% for recipients of social assistance and unemployed persons upon presentation of proof not older than 3 months.

No reductions are granted for study trips, guided tours, sightseeing, concerts, lectures, individual events, and material costs.

The claim for reduction and its prerequisites must be asserted and proven at the time of registration, at the latest one working day before the start of the event. If the proof of reduction is not available or not recognized, the full fee will be due.

1.3 Organizational Changes

There is no entitlement to have an event conducted by a specific instructor. This also applies if the event was announced with the name of an instructor. The VBW may change the location and time of the event for objective reasons. If an event unit has to be canceled (e.g., due to illness of an instructor), it can be made up. However, there is no entitlement to a replacement date. See also points 2.5 ff of the Terms and Conditions.

1.4 Withdrawal and Termination by the VBW

A minimum number of participants is necessary for an event to take place at the stated fee. If this minimum number is not reached, the VBW may withdraw from the
contract. Paid fees will be refunded. Participants have no further claims. If the VBW wants to conduct an event despite falling below the minimum number of participants, the duration of the event will be shortened with the agreement of the participants at the same fee, or a fee surcharge must be paid. The VBW may withdraw from the contract due to the absence of the instructor or for other important reasons.

The VBW may also withdraw from the contract or terminate it if an event cannot take place in whole or in part for reasons for which the VBW is not responsible. In this case, the participant has to pay the fee for the teaching units that have already taken place on a pro-rata basis. Fees will not be refunded if an event has to be canceled by the VBW due to force majeure. The VBW may terminate the contract without notice in the special cases of § 314 BGB for good cause.

1.5 Cancellation and Withdrawal by the Participant

For cancellations up to 10 days before the start of the event, the payment obligation is waived. Already paid fees and special costs will be refunded in full. For later cancellations up to one working day before the start of the event, a cancellation fee of 30% of the fee, but at least 5 EUR, will be charged. Special costs must be paid in full.

From the day the event begins, there is no entitlement to a refund of the fee and special costs. This also applies in case of illness and changes in the personal or professional circumstances of the participant. Any statutory right of withdrawal (e.g., for distance selling transactions) remains unaffected. The cancellation or withdrawal must be made in text form (e.g., letter, fax, email).

1.5 Certificates of Attendance

Participation in an event can be certified upon request, provided there is regular attendance (at least 80%). The issuance of a certificate of attendance beyond this is possible up to two years after the end of the year in which the event concluded.

1.6 Data Protection

The Volksbildungswerk Klarenthal e.V. is subject to the regulations of the Federal Data Protection Act in its current version as well as the General Data Protection Regulation. Further information can be found in our privacy policy statement. For the purpose of managing events, the VBW uses automated data processing. Upon registration, the following data is collected: name, first name, address, age, gender, nationality, telephone number, course number, semester, course title and fee, and in case of direct debit authorization, the bank details.

For statistical purposes, the classification into age groups and the indication of male/female are further processed anonymously. For the purpose of the direct debit procedure, name, first name, bank details, fee, and event number are transmitted to the VBW’s house bank. By registering, participants agree to the processing of the data. Attention is drawn to the relevant data protection regulations.

ESSENTIAL INFORMATION FOR BOOKING A STUDY TRIP AND DAY TRIP WITH VOLKSBILDUNGSWERK KLARENTHAL E.V. (GENERAL TERMS AND CONDITIONS FOR STUDY TRIPS/DAY TRIPS)

2.1 Registration/Travel Confirmation

With your registration, Volksbildungswerk Klarenthal e. V. offers the conclusion of a travel contract as binding. Registration should generally be made in writing. The contract is concluded with the travel confirmation by Volksbildungswerk Klarenthal e. V. If the travel confirmation contains deviations from the advertised program that are unreasonable for you, you are entitled to declare your express non-acceptance within 10 days.

2.2 Payment

When you register with us, you will receive a travel confirmation and, upon request, a travel price security certificate. Upon delivery of this travel confirmation, 20% of the travel price is due. You then pay the rest of the travel price up to four weeks before the start of the trip. The security certificate embodies the security required by § 651k of the German Civil Code (BGB): If travel services are cancelled due to insolvency or bankruptcy of the tour operator, the insurance company assumes the repayment of the paid travel price as well as additional necessary expenses for the return journey. Thus, payments you make towards the travel price are secured from the beginning. If you have not paid the full travel price by then, we are exempt from the obligation to take you along. In this case, Volksbildungswerk Klarenthal e. V. may demand compensation in the form of a flat-rate cancellation fee. Modified payment terms apply to educational trips with opera and theater tickets.

2.3 Services/Unused Services/Prices

Binding for the scope of contractual travel services are exclusively our service descriptions in the detailed travel information sheets, or in short form, the information in the written travel confirmation. Side agreements that change the scope of contractual services require our express confirmation. There is no entitlement to a refund for travel services not used by you.

General Terms and Conditions Supplement for trips from 2019: Changes and deviations of individual travel services from the agreed content of the travel contract that become necessary after the conclusion of the contract and which were not brought about by us in bad faith are only permitted insofar as the changes/deviations are not significant and do not affect the overall design of the booked trip. We are entitled to adjust the price subsequently if we are forced to do so for justified, unforeseeable, and substantial reasons (e.g., changes in fuel costs, taxes, fees, etc.) and if there are more than four months between our travel confirmation and the scheduled start of the trip. We will inform you immediately before the change.

2.4 Cancellation/Non-Commencement of the Trip by the Customer/Cancellation Fees

You can withdraw from the trip at any time under the following conditions:

The cancellation declaration can be made in writing or in person at the office, but should be made in writing for evidentiary reasons (the date of receipt by mail is decisive).

The following flat-rate cancellation fees apply to our trips:

After confirmation of registration up to 50 days before the start of the trip, 10% of the travel price;

from the 49th day until the 20th day before the start of the trip, 40% of the trip price;

from the 19th day until the 10th day before the start of the trip, 75% of the trip price;

from the 9th day before the start of the trip and in case of no-show, 100% of the trip price;

already paid admission tickets, such as for opera and theater, cannot be refunded.

Travel cancellation insurance is not included in the travel fee. We recommend that you take out appropriate insurance on your own.

2.5 Cancellation by the Tour Operator

In the following cases, we are entitled to withdraw from the travel contract before the start of the trip or to terminate the travel contract after the start of the trip: Without observing a deadline, if the trip is significantly hindered, endangered, or impaired due to unforeseeable force majeure (e.g., war, natural disasters, and strikes); without observing a deadline, if the traveler persistently disrupts the execution of the trip despite a warning from our tour guide or behaves in such a way contrary to the contract that immediate termination of the contract is justified. Quality is our top priority.
At the same time, we want to offer you our educational trips at affordable prices. This is only possible if a certain number of interested parties register for group trips and the minimum number of participants is reached. Since no one can guarantee this, but we also do not accept any compromises on the quality of services, it may happen that we have to cancel a group trip at the latest three weeks before the start of the trip.

2.6 Liability of the Tour Operator

As the tour operator, Volksbildungswerk Klarenthal e. V. is liable for the conscientious preparation of the trip, the careful selection of service providers, the accuracy of the service description, the proper provision of the agreed travel services in accordance with local conditions in the destination country, and for any fault of the persons commissioned by us.
For flights, we are liable within the framework of the provisions of the Air Traffic Act in conjunction with international liability agreements, especially for delays and luggage losses. For all flights, the transport conditions of the operating airline apply to air transport. We are generally not liable for third-party services that are not part of the booked trip. We are not liable for flights booked in your name that are not part of the travel fee.

2.7 Duty of Cooperation of Travel Participants

In the event of any service disruptions, travel participants are obliged to do everything reasonable to contribute to remedying the disruption and to keep any resulting damage to a minimum. However, if travel participants have any complaints for which we can be held responsible, they must immediately contact the VBW tour guide. He will immediately endeavor to remedy the situation. There is no later claim for reduction of the travel price or compensation for defects not reported on site.

2.8 Miscellaneous

Travel participants are solely responsible for compliance with passport, visa, customs, foreign exchange, and health regulations. All disadvantages and costs arising from non-compliance with these regulations are at your expense. Information of any kind is provided to the best of our knowledge, but without guarantee. The postal risk lies with the customer. Printing and calculation errors are reserved.

2.9 Place of Jurisdiction

For legal disputes, the place of jurisdiction is agreed to be Wiesbaden.
